General Terms and Conditions
The Terms and Conditions relate to the Manage My Energy (MME) auto-switching service (the “Service”), by which you the subscriber (also referred to in these Terms and Conditions as “you”) authorises us (Manage My Energy) to assess your energy and water supply contract(s) from time to time and, where we deem appropriate, to switch energy contract or supplier on the subscriber’s behalf using our own assessment and judgement using a range of systems and algorithms in choosing the deal which is best suited for you the subscriber according to information provided to us relating to you the subscriber’s energy consumption.

The Service is provided by Manage My Energy (also referred to in these Terms and Conditions as “MME”, “we” or “us”), a company registered in England and Wales (company number 12341538) having a registered office: Dock, Pioneer Park, 75 Exploration Drive, Leicester, LE4 5NU.

Upon registration to the Service and acceptance of the Terms and Conditions, these Terms and Conditions shall become a binding contract between you and us.

These are the current Terms and Conditions for the Service and replace any previously accepted or published version.
Changes to Terms and Conditions
From time to time, we may update these Terms and Conditions to ensure that they are relevant and up-to-date reflecting changes that we may introduce to the Service and the changing requirements of the law and regulatory requirements that may be applicable to the Service.

Any modified version of these terms and conditions will be published on this section of our website you will be notified by email or through such other means of communication that you may provide to us. If you do not agree to any modified terms and conditions, then you must immediately cease all use of the Services since your continued use of the Services after modified terms and conditions have been published and notified to you will constitute your acceptance of those modified terms and conditions.
Our Service to You
We use the information you provide to assess your energy needs and decide which of the current available deals best suit your needs, but we do rely on the information you provide regarding your property and energy usage, also past energy bills. We do not independently verify this information and rely on your information. It is therefore your responsibility to ensure the information you provide is as accurate and up-to-date as possible. As part of our ongoing service to ensure you are always on the best possible deals and to switch your energy, we may access information held about you and your current energy supply by selected third parties.

As part of the selection process to find the best possible deal for your needs, we look into a broad range of factors and requirements you have selected or suggested. These will impact the energy supplier we can select for you, the deal you may get, the length of time for the offer and the contract. Other things we also consider are the customer ratings, quality of service, customer service, track record, financial stability, plus any other information which may be available to us. Due to the service you expect from us, one of the key criterias we look at is in terms of actual energy cost to you to ensure value for money. However, this may not always be the cheapest deal on the market depending on your requirements, such as green energy, etc.
Auto-renewal Service
As part of our service to you we auto renew your contract when a better deal is found, or you have come to the end of your current contract. This means you can contact us while you are still in contract and we can switch you automatically to the best offer for you at that time automatically.

You can terminate your subscription with us at any time by giving us notice through our website or directly with our customer service team. You must notify us you wish to move away from our service.
Acting on your Behalf
By consenting to our service, you appoint us to act on your behalf strictly in connection to your Gas, Electricity and Water supply. We will act for and on your behalf including by: accessing information held about you by third parties; terminating your existing legal relationships with providers of products or services; and/or negotiating and concluding new legal obligations between you and providers of new products or services.

We do not represent or act as the agent for any energy supplier in connection with the Service or in connection with the supply of energy. Whilst we may have commercial relationships with energy suppliers and may negotiate collective deals with energy suppliers, in providing the Service we act independently using our own systems and algorithms to select energy suppliers and the best deals for you.
General Consent
Our Energy switching services are intended for use only by customers who are aged 16 or over and located in England, Wales and Scotland. We do not warrant or represent that the Services will be available or appropriate for use outside of England, Wales or Scotland and any use of the Services by you from other locations will be at your sole risk.

Credentials
To use our service, you will need to provide us with some basic information which will create an account for you. Your log-in credentials are personal and should not be shared by you. User names and passwords and other subscription log-in credentials provided to you for the purpose of accessing the Service (“Account Credentials”) are personal and must not be shared. You must keep Account Credentials secure.
Use of our Service and Restrictions
Our Service is provided to you for the purpose of obtaining the best energy supply deals in relation to gas, electricity and water, for you for business, private, personal purposes and to help manage private energy supply.

Unless arranged and agreed in advance with us, the use of the Service for any commercial or research purposes (including, without limitation, to conduct any surveys or to scrape or collect any data, to carry out competitor analysis or price research, to monitor the Service or third party energy deals or offers) is strictly prohibited.

All the following is prohibited and may result in the immediate termination of the subscription without liability and may be reported to relevant authorities:

The misuse of any data or information on this website;

The interference or disruption of this website and its services;

The compiling, extraction of data from this website ;

The unlawful use of the Service or its use for unlawful purposes;

The provision of misleading or inaccurate data to us in connection with the Service;

Unlawful access of subscriber’s account without the subscriber’s express authorisation;

Registration to gain access or using the Service, or obtaining any product recommendations, data or other input from the Service, through automatic means;

The use of our Service for the purpose of developing, providing or carrying out any service or business targeting third parties;

The use of our Service in a manner intended to cause overload or disruption to our website.
Data Collection
For us to provide you with our service we need to collection some of your information, this data may be obtained through various means, such as forms, surveys, questionnaires, etc.

All data obtained will be protected in accordance with the law and our privacy policy.
Indemnity
You agree to indemnify us, our directors, employees, agents, representatives (“Indemnified Persons”) and keep us indemnified against any loss, damage, cost or liability arising to any Indemnified Persons as a result of any claim, demand or proceedings brought or threatened against the Indemnified Persons in connection with any breach by you of these Terms and Conditions, including any breach of warranty, or any misrepresentation or negligence in relation to your subscription to the Service or its use, or out of your use of the Service in contravention of these Terms and Conditions.
Force Majeure
Manage My Energy declines any responsibility for disservices due to events of force majeure if unable to execute the service according to the terms of the contract. Force majeure, employment disputes, disruption of operations through the fault of no party, civil disturbances, measures of any authority and any other similar unavoidable events which are not our fault shall entitle us – not withstanding our other rights - to withdraw from the contract, in whole or in part, insofar as such are not short in duration and such cause a substantial reduction in our purchase requirements.
Limited Liability
Manage My Energy will have no liability whatsoever for promotions hosted by third parties, or for any damage, liability or loss that you may incur, or to any other undesirable consequences, resulting from:

any suspension, delay or disruption of the Service, including where such suspension, delay or disruption results from our negligence and even if as a result of such disruption, an opportunity to switch to a better energy deal on your behalf was lost;

the loss or corruption of any data (including User Contributed Data);

errors or inaccuracies in delivering the Service including innocent errors in assessing and choosing the best energy supply deal for you.
We shall have no liability whatsoever for any damage, liability or loss that you or any other person may incur, or to any other undesirable consequences, resulting from of your breach of your warranties or other obligations under these Terms and Conditions including, without limitation, the obligation to provide us with accurate, up-to-date and not misleading information and the obligation to keep log-in details and password secure or from the sharing of these details with any other person.
Right to Terminate
We reserve the right to terminate our service to you at any point if you breach our terms and conditions, including in any event of you provided inaccurate, false or misleading information. In such circumstances you will not be entitled to any form of compensation or refund to any monies paid out or otherwise.
